1. Agreement to Terms

Tomkins Electric LLC provides professional electrical contractor services, including but not limited to:

• Wiring and rewiring for residential and commercial properties
• Security system and surveillance equipment installation

• General electrical installations and fixture mounting
• Electrical troubleshooting and repairs

3. Service Agreements

All electrical work is subject to a written service agreement or work order that details the scope of work, estimated costs, and timeline. By signing a service agreement or authorizing work to begin, you agree to pay the stated fees and comply with these Terms.

4. Estimates and Pricing

We provide free estimates for most projects. Estimates are based on our assessment of the work required and may change if the scope of work changes. Final pricing will be communicated before work begins. We reserve the right to adjust pricing for unforeseen conditions that were not apparent during the initial assessment.

5. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept the following payment methods:

• Cash
• Personal checks (with proper identification)
• Major credit cards

Late payments may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to place a lien on property for unpaid services in accordance with Florida law.

6. Warranties and Disclaimers

6.1 Workmanship Warranty

We warrant our workmanship for a period of one (1) year from the date of completion. This warranty covers defects in installation work but does not cover normal wear and tear, misuse, or issues caused by third parties.

6.2 Equipment Warranties

Equipment and materials we supply are subject to manufacturer warranties. We will assist in facilitating warranty claims but are not responsible for manufacturer warranty terms or claim outcomes.

6.3 Disclaimer of Implied Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, WE PROVIDE SERVICES "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE SPECIFIC ENERGY SAVINGS, PERFORMANCE OUTCOMES, OR RESULTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMPKINS ELECTRIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM OR RELATED TO OUR SERVICES OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

8. Customer Responsibilities

You agree to:

• Provide accurate information about your electrical systems and property
• Ensure safe and reasonable access to work areas
• Obtain necessary permits if required and not obtained by us
• Secure pets and keep work areas clear during service
• Communicate any known hazards or special conditions
• Pay for services as agreed

9. Cancellation and Scheduling

Appointments may be canceled or rescheduled with at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee. We reserve the right to reschedule appointments due to weather, emergencies, or other unforeseen circumstances.

10. Intellectual Property

Our website content, including text, graphics, logos, and images, is the property of Tomkins Electric LLC and protected by intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

11. User Conduct

When using our website or services, you agree not to:

• Violate any applicable laws or regulations
• Submit false or misleading information
• Interfere with our operations or systems
• Use our website for any unlawful purpose
• Attempt to gain unauthorized access to our systems

12. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. Each party shall bear its own costs.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal actions shall be brought in the courts of Monroe County, Florida.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and Tomkins Electric LLC regarding use of our website and services.
